Frequently Asked Questions
During the course of our ongoing litigation consulting and data analytics work, the Verdict Consulting Group team has organized a series of frequently asked questions. Litigation partners often want to evaluate whether we are the right fit, so we’ve covered as much as we could, spanning what we do, how we work, the data, and engagement rates. If your question is not answered here, reach out directly at Inquiries@VerdictConsultingGroup.com or use the form below.
What We Do
-
Litigation consulting is the analytical work that sits underneath a legal argument. Verdict Consulting Group takes the financial records, claims data, communications, and transactional documents at the center of a matter and turn them into something counsel can actually use. By doing so, our team develops a clear picture of what happened, where the exposure lies, and what the evidence supports. We are not attorneys and we do not practice law. We build the analysis that helps your legal theory hold up.
-
No, and that is deliberate. Verdict Consulting Group works as a confidential consulting expert, which means our work product stays privileged and is not subject to discovery. We do the deep analytical work, find what the data actually shows, and hand your team a road map. Counsel takes that road map to the testifying expert.
The separation matters. When one firm handles both the analysis and the testimony, the lines blur and everything becomes discoverable. We keep the work siloed. We never speak to the testifying expert. You do. That structure protects the analysis, protects privilege, and gives your expert the strongest possible foundation without exposing how it was built.
We also frequently come in behind an expert report to pressure-test it. On a recent damages matter, we reviewed the expert's analysis before trial, found the gaps and errors opposing counsel would have surfaced on cross, and made sure our client's expert was ready for them.
-
Yes. Early case assessment is where Verdict Consulting Group adds the most value. Before a complaint is filed, before a demand letter is answered, before positions harden, we can tell you what the data actually supports. Claims are stronger when they are grounded in what the record shows rather than what the record is assumed to show. Affirmative defenses are stronger for the same reason. Bringing us in early means fewer amendments, fewer surprises, and a case theory built on evidence from the start.
-
Yes. Verdict Consulting Group handles collection, processing, and analysis across large and complicated data environments. We have built custom collection solutions for matters where off-the-shelf tools could not ingest the data, managed discovery operations across matters with more than a hundred parties, and conducted production-completeness analyses that surfaced deficiencies in opposing productions. For firms without an in-house eDiscovery function, we serve as that function.
-
Yes. Verdict Consulting Group supports the full litigation lifecycle. We prepare the exhibits, findings, and narrative your team needs at deposition, hearing, arbitration, and trial. We stress-test our own analysis the way opposing counsel would, probing assumptions and running sensitivities so the gaps close before the other side finds them. And because the analytical environment runs locally and quickly, records and figures can be pulled up on the spot during a hearing.
How We Work
-
Most consulting firms sell you a senior person and staff the matter with junior analysts. The managing director who pitched you cannot answer a question about your own case at eleven at night because they have not touched the data. That gap is the biggest pain point in this industry, and our entire model is built on the opposite side of it.
The senior person you meet is the senior person doing the work. We are deliberately small and deliberately selective. We take engagements where rigorous financial and data analysis can change the outcome, and we treat every finding as if it will be challenged. We are not a fit for most matters. For the ones where partner attention actually matters, there is no better team to have on your side.
-
A senior team member conducts the analysis, start to finish. The person who pitches you is the person doing the work at Verdict Consulting Group. No handoff to junior associates, no bait-and-switch between the pitch and the engagement.
-
Response is measured in hours, not days. There is no help desk because the person you would call is the person doing the work. If you have a motion due and need a figure verified at the last minute, that is exactly the kind of call Verdict Consulting Group is built to take.
-
Yes, and we regularly do. Verdict Consulting Group has processed and analyzed nearly a million documents for a DOJ production, built forensic datasets spanning millions of healthcare claims, and reconciled more than two decades of quarterly reporting in a nine-figure dispute.
Two things make that possible. First, the analytical environment we build per matter does the heavy lifting that would otherwise require dozens of reviewers. Second, we scale through trusted relationships rather than headcount. When a matter demands additional analysts or domain experts, we bring in specialists we have worked with before, and we have staffed as many as nineteen people on a single engagement. The senior team stays constant. Capacity flexes around it.
-
Yes. That responsiveness is core to how we operate. Late-stage requests are not an exception to our model; they are one of the reasons firms keep us on the bench.
The Data
-
The analytical environment is built per matter and connects directly to whatever source systems are relevant to the case. Claims data, billing records, financial transactions, communications, order activity, contracts, operational documents. We have handled non-standard formats that vendors quoted six figures to extract, and we have reconstructed usable datasets from records that had been sitting in binders for thirty years. If it can be ingested, we can build around it.
-
Yes. We are HIPAA certified and build HIPAA-compliant environments for every engagement that requires one. Data is siloed by matter with full audit trails, and access is limited to the people working the case. We have handled protected health information across millions of patient records, DOJ productions under subpoena, and trade secret matters where the data itself was the subject of the dispute. Discretion is not a policy for us. It is the reason clients come back.
-
Yes. Verdict Consulting Group is engaged as a confidential consulting expert, typically through counsel, which places our work product within the attorney work product doctrine and outside the scope of discovery. This is why we maintain strict separation from testifying experts. It protects the privilege, and it means you can think out loud with us about the weaknesses in your case without creating a discoverable record.
-
Yes. It is fast and runs locally, so records and figures can be pulled up on the spot in a hearing or at trial. When opposing counsel makes a claim about the record, you should not have to take it on faith.
Engagement & Cost
-
Verdict Consulting Group bills hourly. There is no subscription, no platform license, and no minimum retainer. If we host documents on our analytical environment for a matter, that is billed as a separate software fee. If we do not, there is no platform charge at all.
We engage two ways. Matter-specific engagements are the traditional consulting path, typically for larger firms with a single high-stakes matter that needs dedicated analytical support. We embed with the trial team and deliver against the case theory. On-demand support is for boutique and mid-size firms that do not have an in-house litigation support function and do not want the overhead of one. We become that function, available when a matter surges and costing nothing when it settles.
-
No, there is no minimum commitment on either work model.. You are billed hourly against actual work. No minimums, no fixed costs during quiet stretches, no fee for capacity you are not using.
-
Hourly rates. If we host documents on the platform for a matter, that is billed as a separate software fee.
